D.2) 10:31 A.M.   Pursuant to Notice No. 2026-19, the Board of County Commissioners will conduct an appeal hearing to discuss and consider Application  CUP26-004 submitted by Modern Land and Development, LLC. to request a conditional use permit to allow for a Recreational Lodge (ECC 4-1-9) and up to five (5) Chair Lifts in an Open Space (OS) District. LOCATION: APN 006-510-019, a 2,296.22-acre (+/-) parcel, as shown as Parcel 11 on the Amended Record of Survey for Elizabeth S. Rabe Trust, on file in the Office of the Elko County Recorder as File No. 656272, being located in portions of Sections 10, 14, 15, 21, 22, & 23 T. 32 N., R. 57 E., M.D.B.& M., County of Elko, State of Nevada. APPLICANT: Modern Land & Development, LLC OWNER: Ruby Mountain Ranch Holdings, LLC   The appeal hearing was requested by the following appellants:  Elko Band Council, Heather Bair, Carol Nicholson, William Johnson, John George et al, Dionne Stanfill-WR Cattle Co.-Ruby Heritage, LLC-Rachel John, Fermina Stevens, and Steven McDade following a decision of Elko County Planning Commission.   The Commission will hear public comments, consider staff recommendations, and deliberate on the proposed conditional use before taking possible action to sustain (affirm), modify, or overrule (reverse) the Planning Commission's decision to approve the application.

    Commissioner Genseal was exactly right when he said this new request was just putting a "different color lipstick on the same pig." This CUP appears to be a foot in the door so eventually the AR zoning that was previously denied, will be granted. Should that occur, in addition to the 1/2 acre sized resort, chairlifts and ski runs, he will also be able to subdivide much of the parcel into 5 acre lots which could be hundreds of houses/condos. We don’t have the water & infrastructure for that, let alone the environmental and visual damage that will occur from the chairlifts, ski runs and potentially hundreds of homes.

    A conditional use permit is discretionary. The County should respect the overwhelming will of its constituents and reject a wealthy nonresident’s plan to build 5 chairlifts and the ski runs that go with them.
